Terms and Conditions

Welcome to Sunshine Guide Group LLC. By requesting to book one of the properties we manage, you agree to the terms and conditions outlined in our Rental Agreement and on this page. These terms and conditions are designed to ensure a safe, enjoyable, and fair experience for all our guests and property owners.

Booking and Fees
1. Booking: Reservations can only be made through authorized Online Travel Agencies (OTAs) such as Booking.com, Airbnb.com, and VRBO.com. We do not accept bookings directly through our website; it is intended solely for inquiries about our services, checking property availability, or addressing issues encountered on the booking platform.
2. Additional Fees: A cleaning fee of $300 will be added to the total booking amount at the time of booking. Some properties may also require a damage deposit equivalent to one night’s stay. This information will be displayed on the booking platform listing page at the time of booking.

Payment Methods, Payment Policy, and Rates
1. Payment Methods: We accept payments via credit card, bank transfer, or check. These payment methods will be shown on the booking platform listing page at the time of booking.
2. Payment Policy – Standard Rates: Payment must be completed within 24 hours after check-in or within 24 hours after check-out for verified customers.
3. Payment Policy – Promotional Rates: The first night’s reservation charge is required as a down payment at the time of booking to secure the dates. The remaining balance is due within 24 hours after check-in or within 24 hours after check-out for verified customers.

Cancellation Policy
1. Cancellation: Guests can cancel their reservation without charge up to 7 days before arrival. Cancellations within 7 days of arrival will incur the first night’s reservation charge.
2. Refunds: I applicable, will be processed within 3-5 business days.

Check-In and Check-Out Times
1. Check-In: 4:00 pm
2. Check-Out: 12:00 pm
3. Late Check-Out: Unauthorized late check-outs will incur a $300 charge if they prevent the cleaning crew from accessing the property.

Unless otherwise arranged with Agent, the 12:00 pm check-out time is crucial for the cleaning contractor to perform housekeeping duties. Therefore, please note that unauthorized late check-outs will be subject to a $300.00 charge in the event the contractor’s cleaning crew cannot enter the vacation rental premises.

In an effort to ensure guest privacy, the contractor’s cleaning crews have been instructed not to enter the property while guests’ belongings are still present. This includes personal vehicles. Please ensure that all personal belongings, including vehicles, are off the premises by 12:00 pm unless otherwise already agreed upon by Sunshine Guide Group LLC.

Self Check-In
Detailed check-in instructions will be emailed to guests 3 days before arrival. This email will include the property welcome book, house instructions, and emergency contact details.

Property Use and Restrictions
1. No Smoking: Smoking is prohibited in all properties. A $500 fine will be charged for any violations.
2. No Parties: Parties and events are not allowed without prior approval. Violations will result in a $500 fine and/or immediate expulsion from the property.
3. Noise: Noise must be kept at a reasonable level, especially after 10:00 pm.
4. Respect for Property: Guests must treat the property with respect and care, as it will be used by future guests.

Additional Policies
1. Repairs and Maintenance: Agent shall make repairs as expeditiously as possible after being notified by Renter. Agent and contracted repair professionals shall have the right to enter said premises during reasonable hours to examine and make such repairs as may be deemed necessary for the safety or comfort of Renter. There will be no refund or rebates issued to Renter as a result of the repairs or time required to complete them.
2. Breach of Terms: Should Renter breach any of the terms of this Agreement, Renter shall be liable for all costs, damages, and expenses incurred including reasonable attorney’s fees. In the event that any actions or proceedings are initiated by either party with respect to this Vacation Rental Agreement, the parties agree that venue thereof shall be in the county within which the property is located within the State of California.
3. Personal Items: Upon request of the Renter, any personal items left in and/or on the premises will be returned C.O.D. at Renter’s expense through a mailing service. Shipping and handling fees may be assessed.
4. No Smoking: No smoking on the premises per California Civil Code section 1947.5. A violation of this policy will result in a $500.00 cleaning charge.
5. No Parties or Events: No parties or events allowed without prior approval. Fee may be assessed.
6. No Professional Videography or Photography: Absolutely no professional videography or photography of the rental or within the premises should occur without explicit approval from Sunshine Guide Group LLC. Additional fees may be assessed.
7. Noise Restriction: Please be sure to keep noise at a reasonable level. This noise restriction is mandatory after 10:00 pm. Any infraction of excessive noise could result in a $500 fine and/or immediate expulsion from the property.

Additional Charges
Rates do not include daily maid service (unless noted), gratuities, car rental, food, liquor, laundry, personal items, or excessive cleaning upon departure (e.g., upholstery or rug shampooing, etc.). Guests are responsible for these charges if they are assessed.

Property Management Services
1. Owner Accounts: Only property owners can create an account on our website.
2. Repair and Maintenance: Sunshine Guide Group LLC will make necessary repairs as quickly as possible. No refunds will be issued for time required to complete repairs.
3. Breach of Terms: If guests breach any terms, they will be liable for all costs, damages, and expenses incurred, including attorney’s fees.
4. Personal Items: Any personal items left behind will be returned at the guest’s expense.

Sheets and Towels
Sheets and towels are provided at all of our properties. Renters will be charged for missing or damaged linens.

Notice of Absence
You must tell us in advance if you will be absent from the property for 5 days or more. If you do not give us this notice, you will have to pay for any damage that may result from your absence.

Limitation of Liability
Under no circumstances shall Sunshine Guide Group LLC be responsible for any loss, expense, damages, claims, or injury direct, indirect, consequential, or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s), or change(s) in the provision of services or land accommodations by Sunshine Guide Group LLC or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants, or services as substituted; Sunshine Guide Group LLC, at all times, will act in good faith and use its best efforts to substitute with accommodations or services of a type as comparable as possible to those contracted. Sunshine Guide Group LLC will not be liable under any circumstances, including substitutions, to refund any unused portion of booked accommodations or services. Some activities in which guests engage are especially dangerous and include scuba diving, snorkeling, deep-sea fishing, boating, golfing, swimming, boogie boarding, surfing, hiking, biking, and mountain climbing. This list is not all-inclusive but indicates some of the hazards of vacationing in California. Guests may also encounter the following risks: slippery floors and stairs, especially when wet; lanais with spaces between rails (dangerous for little children); precipitous drop-offs on ocean floor; unfenced pools, spas, and ponds; faulty electrical or plumbing systems; gas BBQ grills; clean/clear sliding glass doors; and dangerous stairs or pathways. Therefore, each guest agrees that he/she is voluntarily participating in any and all activities (including use of paddleboard, surfboard, or other beach device provided by property), risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage, or loss to person and property that might result, including, without limitation, any loss or theft of personal property. Any possession or storage of a firearm within the residence must abide by all CA state regulations pertaining; Sunshine Guide Group LLC will not be liable for any violation of these laws or for any injuries or damages caused by said firearm. By booking this property, you acknowledge that in all events and circumstances, Sunshine Guide Group LLC, its officers, and employees shall not be liable. Sunshine Guide Group LLC reserves the right to cancel or rescind any rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the Home Owners Association House Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement.

Condition of Rental
The property shall be in the same condition upon departure as at check-in, normal wear and tear excepted. The owner or its agents may enter the property at reasonable times to make repairs or provide maid service. Guests may cook in areas specifically designated for cooking. Guests must immediately notify the owner or agent of fire or other damage to the property. Guests shall be liable for all acts of the family, invitees, employees, or other persons invited onto the property. Guests may not sublet or assign this rental agreement. Guests shall be responsible to return all keys and gate or garage door openers upon departure. Guests shall abide by the House Rules of the Owner, Property Manager, Condominium Association, and/or the Booking Agent as provided to Guests. Guests will not smoke or vape indoors. Guests will rinse feet off sand as well as ocean tar prior to entering the unit. No parties or events of any kind shall be allowed without prior consent. Additional charges may apply. No catering or outside music permitted without prior consent; additional charges may apply. Guests shall not permit any use of the pool or Jacuzzi by unsupervised children or other guests and shall keep gates closed. Guests and other invitees shall use the pool and Jacuzzi at their own risk. Guests understand that there are certain inherent risks to person and property located adjacent to the ocean or to a golf course, including the possibility of drowning or being struck by a golf ball. Guests acknowledge that the owner would not rent the property unless the Guests accepted this condition.

Privacy Policy
1. Personal Information: We collect personal information to process reservations and provide property management services.
2. Data Security: We take reasonable measures to protect personal information from unauthorized access or disclosure.
3. Use of Information: Personal information is used solely for booking and property management purposes and will not be shared with third parties without consent. More information can be found on our website.

Governing Law
These terms and conditions are governed by the laws of the State of California. Any actions or proceedings arising from these terms will be resolved in the county where the property is located.
